Sweet revenge

I worked for a small design company with about 10 employees. I'm not sure if my boss was an idiot, or just a real A-Hole, but he pays all his employees with hand written checks marked as "commission", which we do not make, having no taxes taken out. Then, at the end of the year he drops a 10-99 on them with no notice. So, naturally I did not have the 3000 dollars I owed the IRS come April. I had to come up with some money.

I found all my time cards for the year, and printed out all my deposits from my online banking. When i added up each pay check, I found that I was shorted money on almost every check. They went from one hour up to 5 or 6 hours a week, as if he had started progressively taking out more money when I didn't notice.

I added it up, it was about $2000. of money shorted on my pay checks.
I also noticed I was not paid any over time on my regular 10 hour day. The missing overtime came to about $1700.

I was pretty pissed, but pretty excited to find out I was owed the amount I had to pay for taxes, and then some. Now, I was the manager of the company at the time. Before I called out the boss, I asked a couple other employees / friends to count up their hours and pay checks and get back to me. They came back with similar results.

I got online and printed out what laws I could find about withholding funds from paychecks being illegal, overtime, etc. I really did not know what I was talking about, but I knew how to add, and I wanted my money that I had worked hard for.

quitting time rolls around, the same day and Mr. Idiot boss man calls a last minute meeting. Of all days, he picked this day to try to make an example out of ME. He got on my case in front of every body saying I need to remember to clock out for lunch because I have not been. So, he is going to start taking an hour off of my time card every day.

Was this set up a gift from god, or was my boss just THAT stupid?

I said "actually...." and plopped down my stack of information proving he has been ripping off his employees. In front of everyone I called him out on it. I requested the extra $3700 be added on to my next pay check and that all the other employees records be checked as well.
He quickly pulled me aside and fired me.

Over the next couple weeks, all the other employees quit and all I received 2 weeks late was half of my last paycheck. Of course, without the requested $3700. Well, there is a law about this too. You must get paid the day you are fired, or the employer must compensate you for every day you wait for the check. All this money was adding up, but I knew I would never see any of it.

4 months later. My old boss calls me up begging me to come in and help him get some things done. I am poor and desperate for work, so I went in. I pretended nothing was wrong as I walked pas the printers that were printing out wide format prints of my personal photography work that was left on the back up drive of my old work computer. I smiled and shook his hand as if I was happy to see him and received directions for the big project. I then sat down at my old computer and "went to work".

I spent a good 2 hours deleting random files. It became kind of a game to scroll through the files stop and a random one and delete as I go through the network. I probably deleted about 3700 files before the computer locked up and would not turn back on. I then told Mr. Idiot boss man "I dont know what happened. It just locked up." Then I went home, feeling much better.

Revenge is priceless.



Wow! I commend you on your research and your confrontation. I wish you had gotten the money owed you. Not sure how you may have followed through on it but an employer who is that sloppy in payroll probably would be of interest to the IRS and the Dept. of Labor.

I think if you did not have a contract with this boss as if you were a subcontractor or were renting space from him he should be turned in to the Irs, the state you live in and unemployment. They will come in and audit his practice and he may owe all the taxes that you say you owe. If the Irs finds the boss at fault I think that he is liable for your taxes along with penalties and interest. Go to www.irs.gov and look under business and look up Publication 15. That will tell you where you fall in regard to being an employee versus subcontractor. As far as your back pay he owes you, if you are an employee you can file a suit against this boss with your local unemployment office. I have done accounting and payroll for years and this person sounds like the jerk I just worked for. After putting in 8 years and being treated like his personal outlet for all that went wrong at work in the field and at home to the point where I almost had a nervous breakdown right before Christmas he told me he was cutting my job due to the economy and he would pay me cash after the first of the year to come in and train his numb nuts brother who only knows how to do grunt work to be the accountant. I acted like I would come back and then called him Jan 2nd and told him I was too busy with interviews. In the mean time the two weeks between the time I found out and the end of the year I did the same thing, dumped tons of info, made copies of all invoices he never paid sales tax on and mailed them to the state so they would have an easy time going in and doing and audit and soaking him for close to $80G plus penalties and interest. Yes revenge is priceless.................
